Important: Capital Gains & Remittance Rules

When buying property in Kenya from abroad, funds must enter Kenya through a recognised financial institution and be evidenced via bank statements for anti-money laundering compliance. Your conveyancing lawyer will require proof of funds. There is no restriction on foreign nationals buying property in Kenya, though they cannot own freehold land — only leaseholds of up to 99 years.

Capital gains on Kenya property are taxed at 5% of the net gain upon sale. If you're a non-resident, you'll need to ensure your conveyancing lawyer files the appropriate CGT returns on your behalf.

Diaspora Property FAQs

Answers for Kenyans abroad buying property at home

Can I buy property in Kenya while living abroad?
Yes, absolutely. Kenyans in the diaspora can buy property in Kenya and there are no restrictions on doing so. You can conduct much of the process remotely — viewing properties virtually, signing documents with a power of attorney, and transferring funds via bank wire or remittance services. You will need a Kenyan lawyer (advocate) to handle the conveyancing.
Can I get a mortgage in Kenya as a diaspora buyer?
Yes. Several Kenyan banks have dedicated diaspora banking products, including KCB Diaspora Banking, Equity Bank Diaspora, and NCBA Diaspora. These allow you to apply for a Kenya mortgage using your overseas income. You'll need foreign income verification, 6 months bank statements, and a clean credit record. Rates are generally the same as local mortgages.
What is the current USD to KES exchange rate?
Exchange rates change daily. Our converter above shows indicative mid-market rates. Commercial banks typically add a 2–4% spread on top of the mid-market rate. For large property transactions, it's worth comparing remittance services like Wise, which typically offer rates closer to the interbank rate.
Do I need to be in Kenya to complete a property purchase?
No. You can grant a trusted person or your lawyer Power of Attorney (PoA) to act on your behalf in Kenya. The PoA must be notarised and apostilled in the country where you reside. Your Kenyan lawyer can guide you through this process. Virtual viewings, digital document signing, and online payment are all possible.
